Verbandsaustritt

Verbandsaustritt bezeichnet den Austritt des Arbeitgebers aus dem Arbeitgeberverband (AGV), zum Beispiel wegen zu hoher Beiträge, Verärgerung über Personen oder um sich der Tarifgeltung zu entziehen. Der Austritt ist verbandsintern wirksam, wenn die satzungsmäßige Kündigungsfrist eingehalten und abgelaufen ist.

Nach dem AGV-Austritt gelten allerdings die Tarifnormen voll weiter, bis der Tarifvertrag endet (Paragraf 3 Abs. 3 Tarifvertragsgesetz). Zumindest eine Zeitlang bleibt der „Tarifflüchtling“ an den Tarifvertrag gebunden – so als wäre er noch im AGV. Der Tarifvertrag kann während der Zeit der Fortgeltung – anders als bei der Nachwirkung – nicht durch eine andere Abmachung, zum Beipsiel durch Einzelvertrag, geändert werden. Entsprechende Rechtsfolgen hat ein Übertritt in den OT-Verband.

Das Handelsblatt warnte vor dieser Strategie der „Tarifflucht“ mit den Worten, das Unternehmen komme so „vom Regen (des Verbandstarifvertrages) in die Traufe“ (des Firmentarifvertrages).

  • Austritt am 01.08.2003 zum 31.12.2003, Manteltarifvertrag abgeschlossen am 01.01.2000, kündbar erstmals zum 31.12.2006
    - der Arbeitgeber ist bis (mindestens) zu diesem Zeitpunkt an den Manteltarifvertrag gebunden
  • Austritt zum 31.12.2003, alter Lohntarifvertrag zum 28.02.2004 gekündigt, Tarifabschluss am 28.03.2004, gültig ab 01.03.2004
    - Bindung an den alten Lohntarifvertrag bis 28.02.2004, keine Tarifbindung an den neuen Vertrag
