Poring over legal provisions—for many, a rather dry affair. For (dual) students, however, a look at Section 27 of our bylaws might be quite interesting. It specifies who is entitled to our legal protection and under what circumstances. Since 2016, there has been a new provision that is quite relevant for students.
Who is eligible for this benefit?
Previously, the right to legal protection in exam-related matters applied only to apprentices in the workplace who are members of IG Metall. Since January 1, 2016, it has also applied to all IG Metall members who are currently enrolled as students at a college or university—including dual-track students and working students.
In what cases is legal protection available for exams?
IG Metall’s legal protection can be granted in cases of failing exams as part of a college or university program. However, it does not cover disputes over grades alone. If, however, continuing one’s studies depends on the exam grade—for example, if a student passed the bachelor’s exam but cannot be admitted to a master’s program due to a numerus clausus—this may still serve as a basis for a favorable legal protection decision under certain circumstances.

Who determines whether you are entitled to legal protection, and how long does the process take?
The IG Metall local office forwards the legal protection request to the IG Metall Executive Board. There, a decision is made promptly as to whether legal protection can be granted. The member is then notified of the decision through their local office.
Students pay a monthly membership fee of 2.05 euros to IG Metall.
